Flow Motion — Terms and Conditions

1. About These Terms
These Terms and Conditions ("Terms") govern your access to and use of the Flow Motion platform, including our website, mobile application, waitlist, and related services (collectively, the "Service"), operated by PATT — Peak Agility Table Tennis (ABN 34 655 700 303), trading as Flow Motion, associated with PATT — Peak Agility Table Tennis, Victoria, Australia ("we", "us", "our").
By creating an account, joining our waitlist, clicking "I agree", or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
These Terms form a legally binding agreement between you and Flow Motion. Please read them carefully.
2. Eligibility
You may use the Service if:
- You are at least 18 years of age, or
- You are under 18 and your parent or legal guardian has consented to your use of the Service and accepted these Terms on your behalf
By using the Service, you confirm that you meet these requirements and that all information you provide during registration is accurate and truthful.
We reserve the right to suspend or terminate accounts that provide false registration information.
3. Account Registration and Responsibility
3.1 Your Account
To access most features, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Keep your account information up to date
- Maintain the confidentiality of your password
- Not share your login credentials with any other person
- Notify us immediately at patabletennis@gmail.com if you believe your account has been compromised
You are responsible for all activity that occurs under your account, whether or not you authorised it.
3.2 One Account Per Person
Each individual must maintain their own account. You may not create accounts on behalf of others, impersonate another person, or create multiple accounts to circumvent restrictions or free tier limits.
3.3 Account Types
The Service supports two primary account types:
- Coach accounts — for coaches who manage player profiles, upload and annotate footage, and assign training plans
- Player accounts — for players and students who access their coaching materials and track their progress
Some features are only available to coach accounts. Your account type is set at registration and can be updated by contacting us.
4. Subscription Plans, Storage, and Payments
4.1 Free Tier
Flow Motion offers a free tier with limited features and usage caps, including caps on video storage, number of connected players, and access to certain coaching tools. Current free tier limits are published on our pricing page. We reserve the right to modify the features and limits of the free tier at any time with reasonable notice.
When you approach or reach a storage or usage limit, we will notify you in-app. If you exceed a limit on the free tier, access to affected features may be paused until you upgrade or free up space.
4.2 Storage Limits
All accounts (free and paid) are subject to video storage limits based on their plan tier. If you reach your storage limit:
- You will be notified in-app and by email
- You will not be able to upload new video content until storage is freed or your plan is upgraded
- Existing content will not be automatically deleted

4.3 Paid Subscriptions
Certain features are only available on paid subscription plans ("Subscriptions"). By purchasing a Subscription, you agree to:
- Pay the applicable fees for your selected plan
- Provide accurate and current billing information
- Authorise us (or our payment processor) to charge your payment method on a recurring basis
Subscription fees are charged in advance on a monthly or annual basis, depending on your selected billing cycle.
4.4 Pricing Changes
We may change Subscription pricing at any time. We will provide at least 30 days' notice of any price increase via email or in-app notification. Your continued use of the Service after the change takes effect constitutes acceptance of the new price.
4.5 Cancellation
You may cancel your Subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will not be charged for the following period, and you will retain access to paid features until the end of the period you have already paid for.
4.6 Refunds
We do not offer refunds for partial billing periods, except where required by Australian Consumer Law. If you believe you are entitled to a refund, contact us at patabletennis@gmail.com.
4.7 Failed Payments
If a payment fails, we will attempt to notify you and retry the charge. Continued failure to pay may result in downgrade to the free tier or suspension of your account.
5. Acceptable Use
5.1 You Agree To
- Use the Service only for its intended purpose — video analysis, coaching, and player development
- Comply with all applicable laws, including Australian privacy laws
- Obtain all necessary consents before uploading footage of other individuals
- Use the Service in a manner that is respectful of other users
5.2 You Must Not
- Upload content that is illegal, abusive, defamatory, obscene, or violates any third party's rights
- Upload footage of individuals without their consent (or, for minors, their parent or guardian's consent)
- Attempt to gain unauthorised access to any part of the Service or another user's account
- Reverse engineer, decompile, or extract source code from the Service
- Use the Service to send spam or unsolicited commercial communications
- Use automated tools, bots, or scrapers to access the Service without our express permission
- Resell or sublicense access to the Service unless you have entered into a separate white-label agreement with us (see Section 16)
- Use the Service to harass, threaten, or harm any individual
- Upload malicious code, viruses, or any software designed to interfere with the Service
We reserve the right to remove any content and suspend or terminate any account that violates these restrictions, without prior notice.
6. Content — Ownership and Licences
6.1 Your Content
You retain ownership of all content you upload to Flow Motion ("Your Content"), including video footage, coaching notes, annotations, voice recordings, and any other materials.
By uploading Your Content to the Service, you grant Flow Motion a limited, non-exclusive, worldwide, royalty-free licence to store, process, display, and deliver Your Content solely for the purpose of providing the Service to you and the connected users you designate (e.g. your players or coach).
We do not claim any ownership over Your Content. We will never use Your Content for advertising, marketing, or any purpose outside of operating the Service without your explicit consent.
6.2 Content You Are Responsible For
You are solely responsible for Your Content and its compliance with applicable laws. You represent and warrant that:
- You own or have the necessary rights to upload Your Content
- Your Content does not infringe any third party's intellectual property rights
- You have obtained the consent of all identifiable individuals captured in video footage
- Your Content does not violate any applicable law
6.3 Beta Feedback and Diagnostic Data
During the beta phase, you may submit feedback, bug reports, or suggestions about the Service. By submitting feedback, you grant us an irrevocable, perpetual, royalty-free licence to use that feedback to improve the Service — including implementing ideas or suggestions — without any obligation to compensate you. We also collect additional diagnostic data during beta to help identify and resolve issues. Participation in beta features is voluntary.
6.4 Flow Motion Content
All content provided by Flow Motion — including the platform, software, design, features, text, logos, and trademarks — is owned by or licensed to us and protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our written permission.
7. Coach and Player Relationships
7.1 Coach Responsibilities
Coaches using Flow Motion are responsible for:
- Managing access to player profiles appropriately
- Obtaining consent from players (and parents or guardians of minor players) before adding them to the platform
- Using coaching tools in a professional and ethical manner
- Ensuring that feedback, notes, and training plans provided through the platform are appropriate
7.2 Working With Children
If you are a coach who uses Flow Motion to work with players under the age of 18, you represent and warrant that:
- You hold a current and valid Working with Children Check (WWCC) or equivalent credential required in your state or territory in Australia (or equivalent clearance in your jurisdiction)
- You comply with all applicable child safety laws, regulations, and standards
- You have obtained written consent from the parent or legal guardian of each minor player before adding them to the platform and sharing any coaching content with them
Flow Motion reserves the right to suspend or terminate the account of any coach who we have reasonable grounds to believe does not hold appropriate clearances or has engaged in conduct that raises child safety concerns. We may report such concerns to relevant authorities.
7.3 Flow Motion Is a Tool, Not a Coaching Service
Flow Motion provides a technology platform. We are not a coaching service and do not employ, endorse, or supervise any coach using the platform. The coaching relationship is solely between the coach and the player. We are not liable for the quality, accuracy, or appropriateness of any coaching advice provided through the platform.
7.4 Connecting Coaches and Players
When a coach connects with a player on the platform, the coach gains access to that player's profile, videos, and progress data. Players can disconnect from a coach at any time through their account settings. Upon disconnection, the coach loses access to the player's profile. Content uploaded by the coach (e.g. annotated videos, notes) may be retained in the player's account.
8. Data Portability and Export
You have the right to export your content before closing your account. This includes:
- Video clips you have uploaded
- Coaching notes and feedback assigned to you
- Progress records associated with your profile
To request a data export, contact us at patabletennis@gmail.com before initiating account deletion. We will process export requests within 14 business days. Once your account is deleted, recovery of your data is not guaranteed.
9. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you agree to our Privacy Policy. Please read it carefully — it explains how we collect, use, store, and protect your personal information, including our obligations under the Notifiable Data Breaches scheme.
10. Third-Party Services
The Service may integrate with or link to third-party services (e.g. YouTube for video imports, Stripe for payments). Your use of those services is governed by their own terms and privacy policies. We are not responsible for the content, practices, or policies of third-party services.
11. Availability and Changes to the Service
11.1 Service Availability
We aim to keep the Service available at all times, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
11.2 Changes to the Service
We reserve the right to modify, suspend, or discontinue any part of the Service at any time. For material changes — defined as changes that meaningfully affect your use of a feature, your data, or your billing — we will provide at least 14 days' notice to paid subscribers. For free tier users, we may make non-material changes without prior notice.
11.3 Beta Features
During the beta phase, the Service is provided "as-is" and certain features may be incomplete, unstable, or subject to significant change or removal. We may collect additional diagnostic data during this phase to improve the product. Use of beta features is voluntary and at your own risk. We value your feedback during beta — see Section 6.3 for how feedback is handled.
11.4 Force Majeure
We are not liable for any failure or delay in performing our obligations under these Terms where such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, internet or infrastructure outages, pandemics, or third-party service failures.
12. Disclaimers
To the maximum extent permitted by law:
- The Service is provided "as-is" and "as available" without warranties of any kind, either express or implied
- We do not warrant that the Service will be error-free, uninterrupted, or free of viruses or harmful components
- We do not warrant that the Service will meet your specific requirements
- Nothing in these Terms limits any rights you may have under the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010), including guarantees that cannot be excluded by contract
13. Limitation of Liability
To the maximum extent permitted by law, Flow Motion and its team members will not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of data, loss of revenue, or loss of business opportunity
- Damages arising from your reliance on information provided through the Service
- Damages arising from unauthorised access to your account where you failed to maintain reasonable security of your credentials
- Damages arising from the actions of coaches or players using the platform
Our total liability to you for any claim arising from your use of the Service is limited to the total amount you have paid us in the 12 months preceding the claim.
Nothing in this clause limits our liability for fraud, gross negligence, or any liability that cannot be excluded under applicable Australian law.
14. Indemnification
You agree to indemnify and hold harmless Flow Motion, its team members, officers, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your use of the Service
- Your Content
- Your violation of these Terms
- Your violation of any applicable law or third-party rights
- Any footage you upload containing individuals from whom you did not obtain proper consent
- Your failure as a coach to hold appropriate Working with Children clearances or to comply with child safety obligations
15. Termination
15.1 By You
You may close your account at any time through your account settings or by contacting us at patabletennis@gmail.com. We recommend exporting your content before closing your account (see Section 8). Cancellation of a paid Subscription is governed by Section 4.5.
15.2 By Us
We reserve the right to suspend or terminate your account at any time if:
- You breach these Terms
- We are required to do so by law
- Your account has been inactive for 12 months (with prior notice)
- We have reasonable grounds to believe you have engaged in conduct that puts the safety of a minor at risk
- We decide to discontinue the Service (with reasonable prior notice to paid subscribers)
15.3 Effect of Termination
Upon termination:
- Your access to the Service will cease
- Your data will be deleted in accordance with our Privacy Policy retention schedule
- Any unpaid amounts owed to us become immediately due
Clauses that by their nature should survive termination (including Sections 6, 13, 14, and 16) will continue to apply.
16. White-Label Arrangements
Use of the Flow Motion platform as a white-label product — including reselling, rebranding, or sublicensing access to third parties (e.g. sports clubs, academies, or organisations) — is not permitted under these standard Terms.
If you are interested in a white-label arrangement for your club or academy, contact us at patabletennis@gmail.com to discuss a separate agreement.
17. Governing Law and Dispute Resolution
These Terms are governed by the laws of Victoria, Australia. Before commencing any formal legal proceedings, the parties agree to:
- Informal resolution — Contact us at patabletennis@gmail.com to attempt to resolve the dispute. We will respond within 10 business days.
- Mediation — If informal resolution fails within 30 days, either party may refer the dispute to mediation through a mutually agreed mediator or the Resolution Institute (resolutioninstitute.org.au) before proceeding to litigation.
- Litigation — If mediation does not resolve the dispute, you agree to submit to the exclusive jurisdiction of the courts of Victoria, Australia.
18. Changes to These Terms
We may update these Terms from time to time. When we do:
- We will update the "Last updated" date at the top of this document
- For material changes (see Section 11.2 for definition), we will notify you by email or in-app notification at least 14 days before they take effect
- Your continued use of the Service after the effective date constitutes acceptance of the updated Terms
If you do not agree to the updated Terms, you must stop using the Service and may close your account.
19. General
- Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Flow Motion regarding the Service.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force.
- No waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.
- Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights to a successor entity without restriction.
